Rhode Island H 7538 Substitute A, signed by the Governor on 2026-06-22, adds a new Chapter 106 to Title 23 of the General Laws, the "Use of Artificial Intelligence by Healthcare Providers Notification Act" (§ 23-106-1). Its purpose is to make sure patients are properly notified when healthcare providers use AI. Section 23-106-2 defines "Artificial Intelligence" as any technology that can simulate human intelligence, including natural language processing, training language models, reinforcement learning from human feedback and machine learning systems. It defines "healthcare facility" by reference to § 23-17-2. It defines "healthcare provider" as physicians, physician assistants, dentists, registered nurses, licensed practical nurses, advanced practice registered nurses, nursing assistants, or any other healthcare professional licensed by the director of the department of health. Under § 23-106-3, healthcare providers and facilities that use AI to document in-person or telehealth visits must notify patients that AI is being used for that sole purpose. They must also review the AI-generated documentation for accuracy after the visit. The bill's text sets no penalties or enforcement mechanism. Under Section 2 of the act, it took effect upon passage.
