Relating to the creation of the artificial intelligence advisory council and the establishment of the artificial intelligence learning laboratory.
Texas H.B. 3808, authored by Harrison, adds Subchapter S to Chapter 2054 of the Government Code to create an Artificial Intelligence Advisory Council and an AI Learning Laboratory. Under Sec. 2054.622, the seven-member council includes one House member appointed by the Speaker, one Senator appointed by the Lieutenant Governor, the department's executive director, and four governor-appointed experts in ethics, AI systems, law-enforcement use of AI, and constitutional/legal rights. The legislative members serve as co-chairs; members receive no compensation. The council must study and monitor AI systems used by state agencies, assess the need for a state AI code of ethics, review automated decision systems inventory reports, and recommend administrative actions agencies can take without further legislation. Under Sec. 2054.623, every executive- and legislative-branch agency must submit an automated decision systems inventory report by July 1, 2026, covering each system's vendor, capabilities, data inputs, bias testing status, intended use, security and data-sharing practices, and fiscal impacts; the council must prescribe the report form by March 1, 2026. Under Sec. 2054.624, the council must establish an AI Learning Laboratory by December 1, 2025, to evaluate AI regulation, encourage AI development in state agencies, and recommend the least stringent regulatory policies. Participants—which may include state agencies, businesses, nonprofits, or open-source projects—must enter regulatory mitigation agreements under Sec. 2054.625, which set testing limitations, safety procedures, liability disclaimers, and may allow reduced civil penalties or correction opportunities before penalties attach. Eligibility criteria are set out in Sec. 2054.626. The council must report to the governor and legislature by December 1, 2026, covering inventory findings, lab results, impacts on residents' liberty, finances, and privacy, and recommended policies. Under Sec. 2054.627, the council is abolished and the subchapter expires September 1, 2029. Council members must be appointed by October 1, 2025, with an initial meeting by November 1, 2025. The Act takes effect immediately upon a two-thirds vote or otherwise September 1, 2025.
