Virginia Chapter 937 (H 1186), approved April 13, 2026, adds section 22.1-20.2:1 to the Code of Virginia to govern artificial intelligence system (AIS) use in public school instructional settings. The Department of Education must compile information on current AI use in schools and publish publicly accessible guidance covering student data privacy (including compliance with FERPA, 20 U.S.C. § 1232g, and COPPA, 15 U.S.C. § 6501 et seq.), teacher training, transparency, bias prevention, and alignment with Standards of Learning. Guidance must prioritize 'division-managed AIS platforms' operated within 'division-managed environments' and require teacher access to transcripts and monitoring dashboards. Each school board must adopt policies consistent with that guidance. The act also establishes the AIS Innovation in Education Pilot Program under subsection D, directing the Department to fund and evaluate safe AIS applications in instruction, tutoring, student engagement, and teacher support, with priority given to proposals serving high-poverty, rural, and under-resourced divisions. Participating divisions must provide educator professional development and submit impact evaluation plans. The Department must report annually by December 1 to the Chairs of the House Committee on Education and the Senate Committee on Education and Health. The Pilot Program expires July 1, 2030 per the act's second enactment clause.
