Artificial Intelligence Workforce Impact Act; established, report.
Virginia House Bill 310 (2026 Session), titled the Artificial Intelligence Workforce Impact Act, adds Article 3 (sections 2.2-622 through 2.2-625) to Chapter 6 of Title 2.2 of the Code of Virginia. The bill establishes a framework for tracking and responding to the workforce effects of artificial intelligence adoption across state government. Section 2.2-622 defines key terms, including 'artificial intelligence system,' 'artificial intelligence-related job impact,' and 'state position.' Section 2.2-623 requires each state agency, beginning January 1, 2028, to submit an annual report to the Department of Human Resource Management detailing AI-related workforce changes for the preceding fiscal year, covering eliminated positions, unfilled vacancies, materially altered duties, retraining efforts, and newly created AI-support roles. Section 2.2-624 requires any agency reporting 10 or more workforce impacts in a fiscal year to submit an Artificial Intelligence Workforce Transition Plan to the Department within 180 days, including strategies for retraining, reassignment, and service continuity, with partnerships encouraged through the Virginia Community College System. Affected employees are made eligible for retraining programs, layoff benefits under DHRM Policy 1.30 and the Workforce Transition Act (§ 2.2-3200 et seq.), and career transition services through the Virginia Employment Commission. Section 2.2-625 directs the Department to compile a statewide analysis and submit an annual report by November 1 each year to the Governor, Secretary of Administration, JLARC, and relevant legislative committee chairs, covering total position impacts, trends, projected workforce needs, and risks to continuity of government services.
