Virginia Chapter 943 (S 394), approved April 13, 2026, adds Section 22.1-20.2:1 to the Code of Virginia, directing the Department of Education to develop publicly posted guidance for the safe, ethical, and equitable use of artificial intelligence systems (AIS) in public K-12 instructional settings. Under subsection B, the guidance must address student data privacy (including FERPA and COPPA compliance), teacher training, transparency, data privacy agreements prohibiting use of school or student data to train external AIS models, bias and discrimination guardrails, professional development for educator AI literacy, equitable access, and alignment with Virginia's Standards of Learning. The guidance must also prioritize division-managed AIS platforms and require teacher access to transcripts of student AIS interactions plus monitoring dashboards and audit logs. Under subsection C, each local school board must establish, implement, and enforce policies consistent with that guidance. Subsection D establishes the AIS Innovation in Education Pilot Program, funded by appropriated dollars, to fund and evaluate innovative AIS uses in schools—covering instruction, tutoring, student engagement, operational efficiency, and teacher support—with priority given to high-poverty, rural, and under-resourced divisions. Participating divisions must provide educator professional development and submit evaluation plans measuring impacts on student learning, teacher workload, and equity. The Department must report annually by December 1 to the Chairs of the House Committee on Education and the Senate Committee on Education and Health. The Pilot Program provisions expire July 1, 2030.
