H.714 has not been enacted. It was referred to the House Committee on General and Housing on 2026-01-16. If enacted, Sec. 1 would add 3 V.S.A. § 269. It defines "automated employment decision-making tool" as software using algorithms, computational models, or AI to materially automate or replace human decision making on employment matters such as wages, hiring, recruitment, discipline, and promotion. Basic tools (calculators, spell-check, spreadsheets) and internal office-management tools that don't materially affect employees are excluded. Under § 269(b), each State agency using such tools must publish and maintain a list on its website. The list must give a description of each tool, the date use began, a summary of its purpose and use, and any other information the agency considers relevant. Under § 269(c), using these tools may not affect existing collective bargaining agreements or the bargaining relationship. It also may not cause discharge, displacement, or loss of position (including reduced hours, wages, or benefits) or impair existing agreements. It may not transfer existing employee duties to a tool. It may not alter existing employees' rights, benefits, terms and conditions, classified service status, or bargaining unit membership. Sec. 2 would create a nine-member Study Committee on Automated Employment Decision-Making Tools and Public Employees. It would examine the effectiveness of the disclosure requirements and whether existing protections are adequate for unionized State employees. It would also examine how the tools interact with collective bargaining dispute resolution. Finally, it would study whether to extend the disclosure and labor protections to municipal employees, teachers and other public school employees, and public higher-education employees. The committee's first meeting would be on or before September 1, 2027. Its report would be due December 15, 2028, and the committee would end on submission of the report or January 15, 2029, whichever is first. Sec. 3 sets an effective date of July 1, 2026.
