An act relating to chatbot disclosure requirements
Vermont H.783, introduced in 2026, has not been enacted. It was read the first time on 2026-01-27 and referred to the Committee on Commerce and Economic Development. If enacted, Sec. 1 would add 9 V.S.A. § 2466e, "Chatbot Disclosure." Under § 2466e(a), no person could engage in a commercial transaction or trade practice with a consumer who is communicating or interacting with a chatbot that may mislead or deceive a reasonable person into believing they are dealing with an actual human, unless the consumer is notified in a clear and conspicuous manner that they are communicating with a chatbot and not a human. This applies whether or not any consumer is actually misled or deceived. Under § 2466e(b), "chatbot" means any artificial intelligence, algorithmic, or automated system that generates information via text, audio, image, or video in a way that simulates interpersonal interactions or conversation. It includes AI agents, avatars, and other computer technology that engages in textual or aural conversations. Under § 2466e(c), a violation is an unfair and deceptive act in commerce in violation of section 2453 of title 9. Sec. 2 would make the act effective July 1, 2026.
